Parental alienation of the elderly: Using Law no. 12.318/2010 by analogy as a protective measure for older adults

The present article focuses on a theoretical review of Parental Alienation, especially regarding elderly individuals, discussing its concepts and historical aspects. Parental Alienation is a behavioral phenomenon within the family context in which an alienating parent, tutor or guardian, commits psychological abuse against the child, seeking the depreciation of a third party, called the alienated. However, it can be observed that the phenomenon can also have the elderly population as victims. Although the elderly are legally protected by the Federal Constitution of 1988, as well as by the Elderly Statute, there is a lack of current legislation protecting them from the psychological violence that the Parental Alienation causes, since Law 12.318/10 lists only children or adolescents as victims. Therefore, to understand the situation of the elderly within the family, as well as the violence they suffer, it is necessary to consider the current concept of family, the rights of the elderly in Brazil, and the definition of Parental Alienation. Moreover, considering the similarities between children and teenagers (already recognized as victims of Parental Alienation) and the elderly, since both are characterized by vulnerability, there is the possibility of using Law 12.318/10, by analogy, as a form of protection for the elderly.
